If what I said in that post is reasonably accurate, one has to wonder what Qualcomm might be thinking (most of the products contain infringing Qualcomm chips). If the trial turns on the basis of the Qualcomm witness admiting infringement, how is that going to look? What might the rammifications be? Will respondents then be looking for their chip suppliers to cover their losses? And will the chip suppliers then look to Qualcomm to cover their losses? Or will respondents sue Qualcomm directly?

Qualcomm and TI are not directly involved, but they may have more at stake than any of the individual respondents. If there is a real risk of what I said above actually happening, would Qualcomm and TI want the trial to get that far?

While witness testimony might kept confidential from the public, that does not make the problem go away. The respondents will know.

Perhaps some real interesting times ahead.
