Maybe not. The ITC deal, which is secret, might be a percentage of all ITC settlements - perhaps at a lower percentage than my hypothetical 35%, granted, but we may never know. Maybe a sliding scale?
Otteson has something like 15 attorneys on this with probably lots of travel. At a year a piece, full-time (2,000 hours) that's 30,000 hours. Say an average of $400 an hour (Ron?). That $12M a year. Plus overheads like office, support staff, coffee etc. I would guess he's looking for a lot more than break-even.
But conceptually I agree - if ITC causes $250M in settlements I would think there's some sort of a cap on his take. So in general, the proportion of actual income that goes to PTSC should indeed increase as that gross income increases.
