"If TPL cannot establish a domestic industry requirement....what then? PTSC's half of the patent is still valid. I cant see this as being a big issue. TPL can still negotiate the license."

IMO the issue isn't the validity of the patent, rather the chances of obtaining a permanent injunction if we are considered to be a NPE. The injunction is what creates fear for the G12 here. If the G12 neeed not fear an injunction than they are in no hurry to settle. There have been NPE's that obtained permanent injunctions, i.e. CSIRO v. Buffalo Tech, however it is getting increasingly difficult to overcome. Of course there is the argument that TPL (1) is not an NPE and (2) the industrys stealing of the MMP prohibited PTSC from successfully competing in this space, but we shall see. All IMO. At least we are closer to the end zone...good or bad.
