I'll make it as simple as I can.
Does the infringing clock have to be the system clock to infringe on the 336? What if there is another CPU which is clocked separately for specific applications?
Is it not possible that these products contain other processors that can infringe, like Qualcomm's Hexagon DSP processor? Qualcomm is on record as calling it a CPU, so there is no question. It does function as a CPU.
I'm simply pointing out that, imo, the system clock may not be the only clock in these devices capable of infringement.
