The domestic industry argument by Garmin is very weak. The subsequent motions that 123Mark keeps trying to scare people with are not dispositive on the argument. We tried to exclude this weak concept with a motion in limine, this is where the judge says we messed up. The argument was allowed to be brought into trial. Period.....

Garmin claims that since the 336 was altered in re-eaxams that DI should start from that point on. The 336 was not changed it was strengthened by the re-exam and most of the claims remained exactly the same. IMO this is a very wek argument and as Otteson pointed out DI will not be a problem.
