Should Judge Gildea be found to lean towards the other side, there is ample proof that he did not give a fair chance to TPL by allowing certain motions that should have been allowed to proceed, given the fact that Agilant pointed out that the judge allowed motions from the respondents to proceed that should have been denied.
So there is a good chance of an appeal should Gildea Rule in favor of respondants, in which his judement may get overturned.....again by a different court.
I do not think Gildea would want to again look incompetent.
