Brian, you make it sound like Mr. O. has no say in the settlement amount. What did they hire him for in the first place, to get the lowest price and help the companies that are infringing?
I think it is his job to bring the best deal possible. And his percentage on the settlement amounts is the incentive.
It's the BOD's job to accept or not accept he brings to the table. And given what you think of the BOD's past work record, I would think that you would rather the call be Mr. O's job.
Given all that, you are right! It is the client who makes the final call. Therefore, God help us all. LOL
I write LOL because or this question: just who are the clients? What if they don't all agree? Did they have a plan or a mission statement going into this? And do you really think the BOD is making the call? Or is it DL or his creditors? Who's names are on the contract with Mr. O.? I bet the BOD is going to make their call for whoever they really are working for now and have been. IMO, the BOD are puppets for a bigger player(s)!
