I don't think anyone knows if the NDoC is truly any different. Can you find the same constructions at the NDoC you posted for the ITC? We lost the ITC and there is another claim construction at the NDoC. Can you help with the analysis to determine the challenges at the NDoC? I did not see one claim construction at the NDoC that has "does not rely on an external crystal clock, etc." I believe the key argument at the NDoC is whether or not process, voltage and temperature are affecting the variable speed of the ring oscillator significantly enough to infringe the 336. Are the effects of PVT enough? I would like to see a PR from the company that does not address the ITC so as to not document it on the net for jurors (i know they are not supposed to google) and focuses on the PTSC being two weeks out from trial and they believe the Markman is strong. That would at least send a message to shareholders they feel the NDoC is more favorable. This is a crap shoot.
