It looks like we won more of the motions and the most important one for me is excluding all references to the ITC initial determination in their entirety, so the jury will not be prejudiced by hearing about the ITC initial determination. We will be allowed to introduce the IEEE article about how the ShBoom microprocessor (MMP patents 336, 749 & 890) was one of the microprocessors that shook the world IF the defendants pursue invalidity arguments during trial. Our licensing expert will be allowed to testify to his base line approach for the licenses, which means we will be able to speak to the 100 licenses of the MMP to the jury and to the total revenue of the accused products. Obviously, Acer and HTC will counter about nuisance values, nevertheless, 100 companies licensing is not typicall of a non-practicing entity. The term patent troll will not be allowed in the court, NPE or similar "professional" terms allowed only. Russell Fish will be allowed to testify and TPL will be allowed to restrict commentary to some topics. The Fish testimony is a wildcard for me. Cmon, Russ! PTSC did pay you 2 million several years back, throw us a bone! There were a couple other items. We could settle with Acer and go HTC only. Who knows how this complicated mess will play out ... lol.
