Pretty cool, Mike. In the link Mike posted, it speaks to a case where there are two sunglass manufacturers and one company asserts their patent against the other. The company that asserted their patent rights ultimately won. The infringing company used one small point on the surface of the sunglasses that equated to 1% of the surface area of the sunglass, and that 1% was not even on a portion of the lense where the eye sees through. The court found on appeal that the 1% was enough. The issue for us is de minimis. I would like to think the dead band should be enough. Maybe we will go all the way to trial.
