After reading HTC's view, it appears good strategy on their part. If HTC is on firm legal ground to submit the ITC ID to the Federal Court for Judge Grewal's review, then Otteson loses this round. The public has not been informed of Judge Gildea's detailed legal reasoning behind his current ITC decision, I believe. Corrections welcome.
Regardless, Judge Grewal's interpretations of the legal issues at hand may be different than at the ITC venue. It appears Judge Grewal's action's to date imply he plans on the case going to trial. IMO, I don't believe the HTC ITC ID will influence Judge Grewal at all.
The admission of the Chackrasian (sp) book is a Big Win in Otteson's column, should PTSC go to trial.
