Judge Grewal better not have allowed the jury instruction update by HTC. Certainly, the MSJ ruling is clear on who won what, but the body of the MSJ did provide HTC with an opening to file their motion. I hope Judge Grewal did not mean to provide HTC with that opening to provide a late stage endaround the NDoC claim construction to incorporate the ITC claim construction for what I will call "judicial balance."
