I reached out to Cliff about the lack of communication to shareholders and received this reply. (My bold):

"Dear _, I appreciate your note. At this time I'm sure you realize that the Company has not made public announcements on matters regarding the on-going litigation venues or actions with the parties therein. The reasons behind our decision not to offer public commentary is based on our understanding of potential unintended consequences that could be detrimental to our larger interests. So it is not due to neglect nor lack of consideration for our shareholders that we are pursuing this course of action, but only after having given it some careful thought.

I look forward to the Northern California trial and the opportunity to ultimately provide an update to all."
