We are not asserting the other claims so they are not at issue and the jury will not consider them. There were arguments about the three "entire" oscillator terms and we tried to, in the original Judge Ware markman ruling, have Judge Ware define entire oscillator to encompass all of the variable speed sytem clock terms as just bein the ring oscillator. I believe the "entire oscillator" term in claim 6 is the easiest to proove to a jury that it is a ring oscillator. I can go on about the strategy and I'm extrapolating from pieces of info to fill in the gaps from the factual sections I've read. Does the trial start today or is it Jury selection?
