The standard is clear and convincing for invalidity. That has been dropped. I am not sure on the history here did they originally sue us for invalidity and non infringement? We counter sued for something I beleive maybe to get all the products we wanted into the case. Is it clear and convincing for infringement as well? Ron will know.
