When Judge Grewal ruled out ITC pre-trial the last ITC event had been the I.D. Then intra-NDoC trial comes the admonition and a "threat" to allow ITC information into the NDoC trial. HOWEVER, given that the ITC I.D. is now under appeal, and that the I.D. is an INITIAL Determination anyway, would it be in any way prudent for Judge Grewal to allow the introduction of something which is not hard and fast decided?
