One could argue that HTC played the game as it is spelled out in the infringers play book. Go on the offensive and file in your venue. Send the patents into re-exam therefore delaying trial by years send mounds and mounds of discovery and try and crush your opponent financially. Through the PTO try and change limit or invalidate the patent enough to either be scott free or change the date of infringement damages. If you fail at invalidity argue that the amount we owe, if we do infringe is peanuts because you can't get anyone to sign a reasonable license while it had a chance to be invalidated and therefore might have had to pay zero. Couple that with their experts being subversive and avoiding questions hopefully these scumbag Chinese companies get hammered. Their attorneys who represent them should be deported. IMO
