While we did not win much in terms of the jury award, I am shocked by a couple developments. The fact that HTC incurred costs approximating $100mil and disclosed this is of huge value. Since the case only invloved some of HTC's infringing products and we now have a legal decision of infringement, it would appear we are sitting in an incredible position. Will HTC try to fight us again or settle quickly to save themselves a HUGE legal bill? We now have an excellent idea of the money at stake. I think it was brilliant to only include a portion of the infringing products in this case (whether intentional or not). The question I have now is whether the other infringing products would be considered willfully infringing were HTC to fight us again. It would certainly appear to add leverage to HTC's decision to fight us.
