"Unfortunately it came at a price, $960K. I'm just pointing out the facts."
Again, I'll remind people, we got $958,560 for $8B worth of revenue collected by HTC for CERTAIN products sold from 2006-2010 or 2011. So essentially, the precedent is arguably that an infringer owes $1 for every $8,345 in revenue a company collects for it's product sales during the infringing period, they owe $1 in licensing fees.
According to the PR announcing the ITC action back it 2012, we cited that we had nearly 100 licenses from companies with a combined annual revenue of $1.4 TRILLION. As there approximately 70 of 100 of the top companies still to license, it would stand to reason that we could have the next 100 licenses have a similar annual revenue. Factor that over 7 years of infringement and you get $9.8T in revenue subject to that precedent license fee.
That equates to $1.17B in license fees. And that is at a rate 10% of what we were hoping for. $1.17B for the next 100 licenses ain't too shabby, but if we can rectify the historical baggage that allowed the jury to lowball us that much, even if only to get 20% of what we were asking, that could mean $2.34B over the next 100 licenses.
The sad thing is that it's people like me on an anonymous message board that needs to decipher and extrapolate to get these possible insights, rather than our company explaining and projecting what the value of the MMP is. THAT in large part is why PTSC lingers at 13 cents after what should have been a seiminal moment in the company's history.
Again, this can be corrected, but the COMPANY has to make the steps to frame and control the dialogue, not go along just to get along, and hope for the best. It's time for the company to begin correcting the sins of the past. Let's hope they are eagerly preparing.
