Completely agree. We gained two things from this trial: 1) Infringement (Big!) 2) A sneek peek at the interworkings of Alliacense, or should we say TPL? (Also Big!).
No matter the defense of, or disgust with our BOD, the trial illuminated some interesting things regarding negotiations. If you learned nothing from it, other then our opponents did a great job of painting us as patent trolls, that would be enough. PTSC chose to initiate, and then subsequently squash, the allegations against TPL concerning fraud etc. I sure hope we didn't settle our concerns and resume licensing with TPL for a grand total of $960K when all was on the line?
I think we all understand that HTC is low hanging fruit. However, enlight of other negotiations that came up at trial, we now definitively know that TPL will sign for fees significantly below the amount initially presented to an infringer. The major problem? The rest of the world now knows as well. I'm no attorney, but I still believe precedent will play a major factor going forward. We got what we wanted, infringement! Unfortunately it came at a price, $960K. I'm just pointing out the facts.
