Ok... but there is only a perceived obstacle... we still have the WIN in court, something we haven't ever had before. I don't consider the ITC an obstacle... it will be icing on our cake but not really a deterrent going forward if they refuse to review and overturn their ruling. What we don't know is whether or not we will get increased licening fees for our efforts. That is the only hurdle I see. Corrections welcome

The determination of infringement in NDoC is obviously big... I think everyone was estatic over thinking the PRs would start rolling out as infringers rolled over (plus anything but that verdict would have basically done us in)... Well there was no PR campaign.. and as far as infringers.. I'm sure they are offering to pay what the jury told HTC to pay.. 1/10 of our conservative tier 3 asking price... TPL is saying c'mon.. you infringe.. we all know it.. they're saying yep.. ok, we'll pay 1/5.. If so.. what are we going to do.. take them all to court?

This is why the ITC is so very important imo... IF we are granted a review (and there is nothing that says they will for sure grant us one.. as political as that areana is..) but hopefully they see fit to grant it.. 1- the Fed verdict 2- Wasn't a key part of Dr O's or some other testimony not allowed due to being filed late?? Some one please refresh my memory here since I wasn't posting those docs and don't have them saved (so I don't have to go back thru all the ITC site docs to try to find it).. Having a successful appeal is imo one of the only things that may be able to force infringers to once again pay an appropriate MMP fee.. that along with removing Leckrone fingerprints and face from the licensing effort.. He is most responsible for diminishing our one great victory in court... tho I'm not sure what the chances actually are of getting him removed.
