So the 8 billion is HTC's total sales? For how long? Wasn't the $958,560 just for certain products in this case, not necessarily the entire 8 billion in revenue?
My understanding is that certain HTC products were culled from a much larger group of potentially infringing HTC products so the case could be streamlined and possibly be easier for a jury to digest... Those products had a value of $8 billion.. I have been under the impression that both sides agreed to these products and their value (corrections welcomed)... Otteson/TPL's damage expert figured the damages to be $10M on these certain products using a tier 3 level royalties rate 0.125%.. HTC citing Apples license fee of a fraction of that at $960,000 believed they owed much less.. I think their damages figure came out to ~$460k on the agreed upon products... as we all know the award was ~$958k.. or < 1/10 of what we were asking and what our Damage expert calculated.. on the agreed upon products.. which is just a fraction of what HTC has produced over the last 6 or so yrs... My and many others concern is that now a precident has been set.. for all the reasons I've stated previously...
If you were HTC at what rate would you want to pay for the rest of your products?
How bout if you were Smasung.. TI.. or low hanging friut.. ?
