"Whether the ID’s findings regarding the “entire oscillator” limitations of claims 6 and 13 are clearly erroneous findings of material fact because they fail to consider Complainants’ substantial evidence that the accused products have ring oscillators." At the minimum at the NDoC Qualcomm and HTC (and possibly TI and the other chip maker) stipulated to the fact that the chips in question had ring oscillators. If ALJ Gildea ruled in his initial determination that there was no proof the chips contained a ring oscillator ... then all I have to say is wow!
