As I stated in a prior post, I believe the variability based on "binning" is the most apparent mistake. We are not even arguing Dead Band, Jitter, Startup mode and we instructed the Commission to skip those portions. I'm not sure how one counters that argument. As for the clock generation and relying on an external crystal, that will be a harder one to overturn IMO. All we need is one or the other realizing there are further arguments addressing other possible errors. It is a coin toss and hopefully the jury verdict at the NDoC helps. Lastly, Obama chooses the Commission members, and the members must be split down party lines. One of Obama's desires is to align the ITC with the Federal Circuit. Well, Commissioners, now is your time considering currently the NDoC is "technically" controlling over the ITC.
