Very intriguing set of events are likely now set into motion.

1. Typically this kind of appeal takes a year. I'd say given the history of this, it's probably going to be 18 months.

2. The length of the appeal will bump against the EOL of the patent. Strategies for monetizing will need to be adjusted accordingly.

3. Not sure how potential licensees will react. I'd say it isn't going to help the present licensing effort (if there was any). Too much uncertainty for anyone to settle for anything but a low dollar nuisance amount.

4. The ITC claim construction and the NDCA claim construction will go head to head. All the previous conjecture on this board will now be (dis)proven.

5. The CAFC case will be THE ultimate defining moment.
