Are we preempting HTC's appeal so we can counter arguments from them? Or has the HTC deadline come and gone and we are truly appealing the claim construction? Hopefully for non-ring oscillator terms. Did the ITC Commission refuse to review Judge Gildea's ID and we are trying to claw back other terms for the 336 and/or other patents?
