There are many strategies that a company can use to provide a range of possible royalty levels. But throwing out gigantic numbers with no basis was stupid and hurt TPL.
Much research can be done using annual reports, market research numbers seen on the internet, purchased financial analyses, etc. to try to generate an idea of the number of unit sales. From there, a reasonable royalty rate (5% or so) can be used to generate a payment number. The wiggle factor, which takes it out of nuisance value, is determining exactly 5% of WHAT amount should be figured in. 5% of the entire unit's cost, 5% of the subassembly, 5% of the part cost? Each of those numbers varies widely, but they are all reasonable bases for calculating damages. What is not reasonable are the silly pie-in-the-sky numbers that were put out before.
