I find it comical that PTSC was allowed what appears to be complete 100% discretion to select the new vendor entity to conduct the MMP Commecialization Program, and that Alliasence was our selection something like 7 days later. I wonder how many formal independent bids for MMP commercialization PTSC can produce in court upon a demand for a showing of alternative competitive options. ... One ? Two ? None ?
I'll repeat my earlier opinion, the exclusive Alliasence relationship with PDS will not be cancelled by force, and they will continue to be entitled to their 25% of all MMP License fees, regardless if some concessions by them are granted.
As far as your PNewco termination criteria, remember that several of those new Agreement documents were requested by PDS to be sealed until 2017
