4. Motion to Appoint Trustee And For Order to Show Cause Re Contempt
16. On December 17, 2014, the Committee filed a motion requesting appointment of a chapter 11 trustee and an order to show cause why the Debtor and Mr. Leckrone should not be held in contempt, due to, among other reasons, the Debtor’s alleged violation of the Settlement Procedures Order, its dissipation of estate assets, its inherent conflicts of interest with respect to affiliated parties, and Mr. Leckrone’s bad faith conduct in the case. The Court heard the Committee’s motion on January 23, 2014, at which time it continued the hearing to March 26, 2014.
5. Derivative Standing Motion
17. As discussed above, the Committee has identified potential causes of action against certain of the Debtor’s insiders and affiliates. In order to pursue and prosecute such causes of action, the Committee requires standing and authorization from the Court. Consequently, your Applicant prepared and filed a motion on January 13, 2014, which requests, among other things, that the Court enter an order (a) granting leave, derivative standing and authority to the Committee and (b) directing the Debtor to provide the Committee with unfettered access to all of the books, records, and other documents in its possession. The Committee’s motion was initially set to be heard on February 26, 2014. However, to permit the negotiations between the Committee and the Debtor to continue, the Court continued the hearing to March 26, 2014.

I hope the judge hammers him next week and we finally have someone willing and able to go into to detail of how when and where licenses were consumated and where the money was allocated. I think our BOD is quite afraid IMO
