Ron will hopefully correct me if I'm wrong, but I'd imagine that if TPL appealed the ITC decision right now, the CAFC would consolidate the cases and do only a single claim construction. Appeals from the NDCA and the ITC end up at the CAFC. So I'm not sure the delay would be signficantly greater than it is now.

Thanks for the kind words, but I'm really just guessing like most on this board. TPL seems to be quite uniquely unpredictable to say the least.
