Message: Better question is what would the Apple License be if we had a BOD on the ball?

The facts are that the HTC Litigation Award is the culmination of years of mis-steps by our BOD agreeing to and allowing Leckrone to run roughshod over our CORPORATE interests. Even the Apple license debacle didn't become an issue UNTIL the commingling underhandedness was made public for PTSC shareholders to officially see in the LEGAL FILINGS of the HTC case & the Marcoux v TPL cases. Only THEN did our BOD make the window dressing effort of suing TPL, and then only to settle with them for terms that were even BETTER for TPL.

The Apple license didn't occur in a vacuum. And there were predecessors to that license that allowed Leckrone to feel like he could totally abuse the MMP license effort to his benefit. Maybe even questionable activities by our BOD that gave him leverage over them. Hard to know, but in the context of the events that have occurred, and the mechanisms Leckrone uses, the question, IMO, sure is open.

Just think where we might be if our BOD had":

  • insisted on an INDEPENDENT member of the PDS management committee and corrected such right after Nielsen was hired by TPL.
  • objected to the commingling back with the Sony deal, instead of after the HTC commingling and Apple deal was made public.
  • supported Chuck Moore in his case v TPL
  • had a plan B game plan for licensing 3-4 years ago
  • etc. etc. etc.

The HTC low award is not just a happenstance result of a legal proceeding and Leckrone's double dealing, it is the just results of the scamming that our BOD allowed right under their noses.

And STILL, there is no effective plan to curtail the licensing problems. We have empty platitudes from our BOD in the form of PDS resolutions against commingling. Of course, they don't mention that they no longer can fire the licensing agent even if it doesn't provide any licensing success. Oh well, I guess our BOD is saving money on donuts and coffee by having a virtual share holder meeting, so we have that going for us.
