Here again is DL's leverage over the Chap 11 Creditor's Committee; this is why they ultimately are bending to him. DL's voluntarily stepping down from the PDS BOD and naming his own replacement (IMO it's his daughter) is an attempt to get ahead of the Court to appoint their own person. I suspect DL's replacement already has, or will get, the approval of the Creditor's Committee. This Reorg Plan is close to a negotiated done deal on the major issues; imo.
It's a joke that PTSC appears to not be exerting itself with it's own Plan to the BK Court, or at least making the argument that we are due special considerations and influences in the Committee's Plan because of the uniqueness of our Joint Ownership of the MMP and it's the continuing impactfulness of the MMP to our company.
Others on the Committee only have a specific amount of debt afterwhich they couldn't care less what happens to the MMP, and how I believe the motivation will likely be to prosecute and compromise in an effort to satisfy and extinguish the committee's trade debts as quickly as possible.
In my opinion, the Committee and Court Plan will sacrifice strategic Patent prosecution for swift cash generation by accepting lower MMP licensing fees in an environment of far lessened fear or threat of legal consequences to the infringers... This is not in OUR Interests as PTSC Shareholders.
This BOD continues to provide failing performance to it's Shareholders ...
