Geoff: Otteson never represented TPL in any aspect of the BK proceeding itself, any funds provided to Otteson during the BK were to pay Agility for those past non MMP licensing legal fees.

PTSC's 10Q filings did infact indicate that Otteson/Agility changed to a Per Hour billing basis, and no longer was Contingency based.

More recently, PTSC put out a PR indicating they were hopeful of a different billing arrangement (non hourly) with Otteson's firm. PTSC's most recent PR (within a week or two) mentioned PDS had retained Otteson to prosecute the MMP, and without being clear on the billing aspect of it, lead the reader to believe that some type of accomodative billing method was achieved.

I think it's likely that a hybrid legal fee arragement resulted, but I believe that it's makeup is heavily weighted towards hourly compensation, with the contingency element only being a minor percentage motivational inducer.
