Moore is really stirring things up because everyone knows what kind of a great deal they got from TPL. From a practical stand-point, unless there is evidence of fraud, I would have to agree that if they signed a deal with TPL, they have a fairly strong case and I would imagine it would be vigorously fought if Moore was successful with his plan and they tried to claw back.

My gut is that the Moore plan would only be viable for future cases and that may be a better strategy. Just my gut from what I feel is practical, not a legal opinion.
