The Judge probably took issue with "If the settlement is not consummated, the parties will proceed with the appeal."

In other words Judge O'Toole may be inferring that if there is/was indeed the spirit of a settlement why would you guys all feel the need to put that caveat into the motion to delay the oral argument?
