Agreed, the District Court level would be unaffected by the Ruling.

In my post I was responding to what I thought Ron correctly identified as where the potential implications might be ..that being openness to the persuasiveness/weight of the ITC's finding's to the Federal Circuit as opposed to the errorless Findings of Grewal's District court to the Federal Circuit.

Today, considering the infringer's known legal strategy, I believe that this Ruling could potentially be hugely positive, and seriously deflate the leverage infringers will introduce on the Construction issue in any venue outside the confines of the ITC.
