"Delays In Deploying A Second Licensing Agent Could Have A Significant And Adverse Effect On Us.
Alliacense had been PDS’s sole licensing agent implementing the MMP licensing program. Alliacense has not generated significant licensing revenues since September 2013. We believe that the deployment of a second licensing company is critical to the successful implementation of the MMP licensing program. Pursuant to the Amended Alliacense Services and Novation Agreement, a second licensing company was engaged by PDS; however, to-date Alliacense has fulfilled only a portion of its obligations under the Novation Agreement associated with the deployment of the second licensing company despite our repeated demands. Alliacense’s inability or unwillingness to fulfill its obligations under the Novation Agreement to enable the successful deployment of the second licensing company could have a significant and adverse effect on our ability to generate revenues from the MMP portfolio."
Does this mean we didn't get the lists of potential infringers, the claims documentation and the associated technical tear downs and justifications? Does this mean the early2015 grandstanding on demands for that information as a precursor to PTSC approving the Plan was for nothing? Does this mean PTSC shareholders have once more been misled by the BoD? Does this constitute fraud, fiscal mismanagement or similar?
