our en banc rehearing was filed (could not post the petition..arguments revolve around proper disclaimer)....I assume that the petition needs to be approved / granted by the court....if so, we would need to make our argument to the entire panel of judges...including those three that already found to the contrary...some have compared these en banc hearings to the rarest shot in golf...if they don't grant, do we appeal this to the Supreme Court?
