Not to get too nitpicky, but seeing as how ``our side`` managed to insult Judge Fogel prior to the Higgins ruling, it`s probably a good idea to point out that Judge Jenkins -- The Honorable Martin J. Jenkins -- is presiding over the current CA action.

Judge Armstrong has been out of this for a while.
