I would say a patent's portfolio (30 something patents in possession of ODIS and few are pending, and new ones are being added as we speak) protcts POET.

In one of the articles about POET you can read a statement that the patent portfolio protects POET being taking over by giants like INTEL or IBM and replicating the technology.
