No it won't take a miracle.

UConn could easily get nothing if their royalty terms make licensing impractical. Unreasonable royalties can crush a company before it can even get off the ground.

The wording seems to suggest that the high royalties apply to the commercial sector. It probably seemed to be a good deal when OPEL was working primarily for military markets. Now that the focus has shifted to growing the commercial side of the business it's not looking so great.

The other part of this is that POET may have more heft going into these negotiations than it would appear on the surface. Let's say POET can table a proposal from, say Qualcomm, and that the deal can go through only if the licensing can be successfully renegotiated. Again, it's all or nothing. UConn can settle for less (but still more than they have been getting for the last decade) and allow POET to scrape a profit to grow the company.

That's obviously hypothetical, but it shows that POET may have leverage at this time to change the terms of the deal.
