It says in the SEC link that there is nothing agreed upon or done yet. Nothing is set in stone yet.

This is smart, covers them for 25 months and allows them to act quickly on a deal since all the paperwork and approval is done.

Therefore if we release news that the VCSEL is completed, we can then quickly take advantage of the market conditions (higher SP) and potentially land a JV quickly without risk of waiting to do all the paperwork, etc..
