I'm going to assume something - so long as whatever behavior is being complained of, was isolated to 2008 (that's my assumption), none of us should lose a bit of sleep over this, irrespective of how it turns out, and so long as it's limited to under a million dollars (could be zero, but if it's several hundred thousand, there's generally interest charged, etc.). But that management group is long gone, so other than, "too bad," it's not a big issue.
I'm sure including it in the recent prospectus was an attempt to "clean house." I'm not surprised.
