You're missing the point; it's anti-competitive.

POET can licence out and give access to all comers who are willing to pay the price.

Apple says "too bad, we don't care how much you'll pay for it"....

I'm not saying this is why POET is, thus far, immune to a takeover, but there are few other explanations other than the SRP.
