In the US where BB Photonics lives, a patent application (or patent pending) offers no protection.

It does not take a lot of looking to establish that this is a false statement. So why would Brundal make such a serious allegation!

under the American Inventors Protection Act, you do gain provisional rights and protections, including the right to secure royalties from those who use your invention after it has been published but before a full patent is granted.
