Only the stock is in escrow, not the cash.  

Being the biggest tranche, this is the one we all want to see closed.  Once $21 million of the $26 million has changed hands, it's more or less a done deal, whether or not it work out for the parties involved.  If the money is not received in the next couple of weeks, I will worry more about the 8th element, about which I worry only moderately currently.

I would suggest forgetting about that article, either very sloppy or intentionally so.
