the point of "manufatured completely outside China" is indeed a sticky one. If my memory serves mw well SPX has sole rights worlwide up to 400G and for "Greater China" above 400G. Sanan would certainly regard Taiwan as Greater China.

So either POET can tweak it to FTI being outside this area, like orders coming from, say, India - or your point 4 would come into play.

As usual we are left guessing, leaving your point 2 more valid than you stated. POET got communication wrong numerous times, so why not another time?

We may find out, if the deal materializes at all - which knowing POET's history is not necessarily a given. I am still hoping some deals will eventually come to fruition, preferrably while I am alive and hope dies last, they say. A little more clarity would be appreciated though after all these years...
