RVXoldtimer, I am not sure that in a ROFR RVX would be in a position to set the price for Apabetalons for the USA the way you suggested. RVX would more than not will refer the matter to say Rothchild for advice as to what the price should be set at. They, in turn, would offer it to HL USA in accordance with the ROFR agreement. If they cannot afford it or back out of the deal entirely, they would be reimbursed the $8M and that end the ROFR agreement.
RVX would than be in a position to deal any which they desire. And I don't see any reason why HL USA would not be able to make a subsequent competing offer.
RVX needs to avoid any sign impropriety awhile the ROFR is in force.
