The case by Noble is part of a recent wave of civil and criminal actions brought against persons alleged to that have spread false and misleading information concerning publicly traded companies in order to drive down their share price and earn illegal returns through coordinated short selling of their stock. In many of these cases, these person are alleged to have first unsuccessfully tried to extort money from the targets of their attacks.

On December 6, 2011, in a landmark decision in an unrelated case with implications for bloggers around the country U.S. District Judge Marco Hernandez found that a Montana based blogger, Crystal Cox, was not a journalist and cannot claim the protections afforded to mainstream reporters and news outlets. He ordered the blogger to pay $2.5 million in damages arising out injuries that Cox caused to an Oregon-based company by spreading false and misleading information concerning the company after her attempts to extort payment from the company were rebuffed. Noble believes that Keith and Victoria Dalrymple do not benefit from the “journalist shield” and will be held liable for publishing false and libelous statements.
