The company is now known as FUSE Cobalt.
The only incidence I remember of High closing stocks was in reference to Mutual funds who kited shares of their larger holdings to bolster their fund valuations.
Motive is the key... if someone is simply supporting his own share holdings value buy buying a few shares whenever he wishes.... there is no crime.
As you previousely stated the market is the market... are you suggesting someone is not allowed to buy stock at the end of the day if it above the last trading price? Stocks are not allowed to move up as they approach the close.... Daaaaaa. Thats rediculous....LOLOL
One could make the same argument about closing the share price down at the end of the day because they want to accumulate or involved in a take over a target company... again any crime must have a motive
Certainly buying a few shares within the context at market is simply confirmation that the seller had the correct "ask " price.
The market is simply the collective optomisium/ pessimisum of investors and potential investors.
It seams the regulators are taking the stance that secrecy is also of importance, thus the large amount of anonamous orders, the multiple unreported alternate platforms, which hide the volume and true depth in the stock... etc etc
